The Governor's Veto Power over New York's Solar Future
New York stands at a crossroads regarding energy autonomy for its most dense populations. State legislators recently passed the Solar Up Now New York (SUNNY) Act, a measure designed to legalize plug-in solar panels that connect to standard outlets to allow apartment and condo dwellers to generate electricity.
The legislation moves the state into a growing cohort of jurisdictions embracing "balcony solar." Currently, seven states have cleared the way for these installations, with more than two dozen others considering similar bills. New York represents the most populous state where this technology has secured legislative approval.
The decision now rests with Governor Kathy Hochul, who has until the end of the year to sign the act into law. The Governor’s stance remains unclear. A spokesperson for Hochul stated that the administration will review the legislation.
This moment is significant because it pits a widespread cost-cutting technology against a governor known for prioritizing an affordability-first agenda that has occasionally stalled climate initiatives. Hochul previously delayed a cap-and-invest program and paused requirements for all-electric new buildings. However, the SUNNY Act carries unique political and economic weight. The proposal earned support from utility Consolidated Edison, breaking from the typical pattern of utility opposition seen in other states.
For renters and apartment dwellers, the stakes are high. Across the U.S., nearly half of households cannot access rooftop solar systems due to renting, living in apartments, or facing shaded or cramped roofs. Legalizing DIY plug-in panels offers a direct path to lowering energy bills for those traditionally excluded from the solar transition.
For lawmakers, signing the bill provides a legislative win ahead of the November midterm elections. For the state, it determines whether New York will lead or lag in the adoption of decentralized, accessible energy technology.
